JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased. According to the prosecution case itself, the informant got information regarding the death of the deceased through the petitioner in the night of the alleged occurrence and having got the aforesaid information, the informant went to the house of the petitioner and found the dead body of the deceased lying on a cot but allegedly petitioner and his other family members forcibly cremated the dead body of the deceased.

Admittedly, the present case was lodged after cremation of the dead body of the deceased, particularly, in the

Patna High Court Cr.Misc. No.32933 of 2015 (5) dt.02-11-2015 2/2 circumstance, when the informant was preset at the house of the petitioner before cremation of the dead body of the deceased and the informant appears to be Chowakidar of Jagdishpur police station.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Murar P.S.Case No. 17 of 2014.
