JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Dhoraiya P.S. Case No.270 of 2016 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 17 litres of foreign made liquor from the motorcycle of the co-accused persons.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated and is said to have been implicated on the basis of disclosure made by the other accused persons, who were apprehended subsequently. The learned

Patna High Court Cr.Misc. No.59591 of 2017 (2) dt.22-12-2017 2/2 counsel further submits that the petitioner is accused in two other cases on same and similar allegations. However, he is on bail in both the said cases. It is submitted that the petitioner is languishing in custody since 09.10.2017.

Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Banka in connection with Dhoraiya P.S. Case No.270 of 2016.
