JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-11-2017 The petitioners seeks regular bail in connection with Narpatganj (Basmatia) P.S. Case No. 285 of 2017, registered for offences punishable under Sections 302/201/34 of Indian Penal Code.

Allegation against the petitioners as per F.I.R is of causing death of the daughter of the informant. It has been submitted on behalf of the petitioners that there is no eye-witness of the occurrence and only allegation is that they were giving electric shock to her and except that there is no allegation against the petitioners and the reason of death was found to be cervical injury. Further petitioners have in custody since 29.06.2017.

Patna High Court Cr.Misc. No.51169 of 2017 (2) dt.13-11-2017 opposed the prayer for bail and submitted that the petitioners were seen giving electric shock to the deceased with a view to screen themselves our from the offence.

Having heard both sides, considering the fact and circumstances of the case and nature of allegation, at this stage, I am not inclined to release the petitioners on bail, rather this application is disposed with direction to the court below to release the petitioner on bail to his own satisfaction once charge is framed in this case with a condition that they will cooperate in the trial and shall remain present on each and every date.
