The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

The prosecution case in short is that the construction work of house of the informant was at fag end. In the meanwhile, the accused persons including the petitioner forming an unlawful assembly, came there and started hurling abuses and in consequence of thereof, on the order of petitioner, the other accused persons gave farsa blow on the head of the informant, as a result of which, the informant sustained bleeding injury. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation

Patna High Court CR. MISC. No.55969 of 2019(2) dt.03-09-2019 2/2 of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 26-06-2019. Charge sheet has already been submitted. There is case and counter case between the parties. Free fight is alleged to have taken place between the parties. The nature of injury is said to be simple. No offence u/S 307 of the Indian Penal Code is made out.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Gopalganj in connection with Barauli P.S. Case No. 221 of 2019.
