The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The prosecution case got initiated on the basis of written report submitted by one Mukesh Kumar to the Town Station House Officer, Jehanabad to the effect that the petitioner being, the LIC agent took Rs.60,000/- for deposit of the premium in two LICs policy, but he neither provided any deposit receipt to the informant, nor the amount was actually deposited. It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.69769 of 2018(2) dt.03-12-2018 2/2 there is no proof with regard to the payment made to the petitioner. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. It is submitted by learned APP for the State there is specific accusation against the petitioner.

Considering the nature of accusation and the willingness of the petitioner to deposit 50% of the alleged amount before the learned Court below, i.e. Rs.30,000/- at the time of furnishing the bail bonds which will be subject to result of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Jehanabad, in connection with Jehanabad P.S. Case No.699 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
