Mr. Parmanand Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-09-2025 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners are apprehending their arrest in Majhauliya P.S. Case No. 309 of 2025 registered under Sections 126(2), 115(2), 109, 303(2), 352, 351(3) and 3(5) of the BNS.

3. As per the prosecution story, all the FIR named accused persons including these petitioners are said to abuse and assault the informant and her family members due to which they got injured. It is further alleged that the accused persons snatched the motorcycle of informant's brother.

4. It has been submitted on behalf of the petitioners that

Patna High Court CR. MISC. No.55463 of 2025(3) dt.15-09-2025 2/2 the petitioners are innocent and they have falsely been implicated in the present case. It is further submitted that both the parties are agnates and injuries inflicted upon the injured persons are found to be simple in nature.

5. Learned APP for the State, on the other hand, oppose the prayer for bail of the petitioners but fairly submits that all the injuries inflicted upon the injured persons are simple in nature.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 309 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
