Petitioners seek bail in Barharia P.S. Case No.253 of 2017 registered under Sections 147, 148, 149, 341, 323, 337, 338, 379, 427, 436, 307, 504 and 506 of the Indian Penal Code. As per the prosecution case, 47 named accused persons including the petitioner nos.13, 14 and 15 blocked the road of the locality of the informant and on protest torched some houses and damaged two houses and also looted away the

Patna High Court Cr.Misc. No.50333 of 2017 (02) dt.17-10-2017 2/ 2 belongings of the inmates.

It is submitted by learned counsel for the petitioners that the allegations levelled against the petitioners are not specific rather general and omnibus in nature. Out of the 15 accused persons 12 are not named in the F.I.R. The injury sustained by the victim is simple in nature. The petitioners have been languishing in custody since 09.08.2017.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barharia P.S. Case No.253 of 2017.
