The petitioner seeks bail in a case registered under Sections 378, 411, 414/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioner were apprehended while fleeing away along with motorcycle of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.4.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. There is enmity between the parties. For the said reason, the present case has been instituted. Other co-accused has been granted bail vide

Patna High Court CR. MISC. No.57091 of 2019(2) dt.11-09-2019 2/2 Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna in connection with G.R.P. (Patna Junction) P.S. case No.160 of 2019.
