The petitioner is apprehending his arrest in a complaint case wherein cognizance has been taken for the offences punishable under Sections 120(B), 467, 468, 471, 406, 409, 420 of the Indian Penal Code. The prosecution case as per the complaint petition is that the petitioner along with other accused persons have hatched a criminal conspiracy in order to cheat the common people and formed five different companies. They accordingly convinced the innocent

No.66904 of 2021(3) dt.12-09-2022 2/3 villagers to invest in different schemes of the companies in order to receive two to three times more interest given by any bank or post office. On believing them, the complainant and others invested their hard-earned money in different schemes of the company but before they get back their money return, the company closed its operation and fled away and thereby cheated 207 people including the complainant.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner is neither Director nor he is concerned with the policy making decision of the company. The petitioner is also a victim of cheating along with the complainant and others.

Learned counsel appearing on behalf of the complainant has submitted that petitioner is the Director of the company and it can easily be found out from the website of the company. The petitioner along with other accused persons has cheated the hard-earned money of

It is further submitted that the petition for anticipatory bail of co-accused Ranjit Kumar @ Rajjit Kumar, who is own brother of the petitioner has been rejected by a coordinate Bench of this Court vide order dated 25.04.2022 passed in Cr. Misc. No. 50409 of 2021. Moreover, during investigation, the materials have come showing complicity of the petitioner in the alleged crime.

Considering the facts stated above, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
