JUSTICE AKHILESH CHANDRA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State, who is armed with carbon/xerox copy of the case diary.

The petitioner, who is languishing in custody, seeks bail in a case registered under Sections 302/34 of the Indian Penal Code, is one of the named accused in this case being husband of deceased daughter of the informant, who died around five years of her marriage after suffering for certain demands and torture etc. and the informant appears arriving at the place of occurrence on informant given on mobile by the deceased while she was allegedly being assaulted, but found dead. Submission is of false implication under some confusion and the informant in his statements, recorded under Section 164 Cr.P.C. as well as during trial, has stated a different story alleging nothing against the petitioner, who, as submitted carries no criminal antecedent. Further, the informant also entered into compromise for which due application is on the record of the court below.

No.42736 of 2014 (3) dt.21-01-2015 2/2 If it is so, in the event of informant appearing before the court below, on due identification, supports the factum of compromise and contents made therein with his free will and consent without any coercion and also stood as one of the bailors, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Gobindganj P.S. Case No. 19 of 2013, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
