The petitioner seeks bail in Daniyawan P.S. Case no.78/2015 registered under Sections 399/401/402/34 of the Indian Penal Code and Sections 25(1-B), B/26/35 of the Arms Act.
It has been contended on behalf of the petitioner that allegedly four live cartridges and one cell phone were recovered from the possession of the petitioner, who is in custody since 30.07.2015. It is claimed that the petitioner is not having any criminal antecedent.
Having regard to the facts and the circumstances of the

No.52619 of 2015 (2) dt.15-12-2015 2 / 2 case, the petitioner, namely, Chhotu Kumar @ Rajesh Kumar is directed to be released on bail on furnishing his bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Ratan, J.M. 1st Class, Patna City, Patna in connection with Daniyawan P.S. Case no.78 /2015 with a condition that one of the bailors must be his father. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
