The petitioner apprehends his arrest in Bheldi P.S. Case No. 186/2015, registered for the offences punishable under Sections 376, 511 and 506 of the Indian Penal Code and Section 7, 8 of the POCSO Act.

The petitioner is alleged to have untied the pant of the victim minor girl in order to outrage her modesty. Then she cried and her brother came.

Learned counsel for the petitioner submits that the informant has got enmity with the petitioner. The informant wanted to use his land for drainage and for that a Panchayati was held. During course of the investigation two witnesses, namely Junar Mahto and Parsuram Pandey have stated that the present case has been filed due to previous enmity on account of land

Patna High Court Cr.Misc. No.43604 of 2016 (3) dt.23-11-2016 2/2 dispute but it appears that the victim who is aged about 7 to 8 years, disclosed about the occurrence and very categorically stated that the petitioner untied her pant with ill-motive and when she started crying, the petitioner fled away.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
