JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-10-2017 The petitioner seeks regular bail in connection with Kashichak P.S. (Sahpur O.P) P.S. Case No. 69 of 2017, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 874 litres of foreign liquor from the pick-up van.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has nothing to do with the seized liquor and he is only the driver of the said pick-up van and he was driving the van on the direction of the owner of the pick up van. Further he has no criminal antecedent and has been in judicial custody since 27.08.2017.
Patna High Court Cr.Misc. No.48786 of 2017 (2) dt.12-10-2017 2/2 Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with the direction to the court below to release the petitioner to his own satisfaction once charge is framed in this case or after completion of total four months of judicial custody of the petitioner, whichever is earlier.
