The petitioner, being the father of the husband of the deceased, is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case as per the written report of Shila Mahto submitted to the Station House Officer of Chakmehsi Police Station is to the effect that the daughter of the informant, Sujata Kumari was married on 06.06.2010 with Prabhat Ranjan Verma,but subsequent to the marriage, further dowry demand of cash and a car was made by the in-laws. Fearing social humiliation, the informant fulfilled the demand of the accused persons. It is further alleged that in the last month of 2016, the

Patna High Court Cr.Misc. No.70816 of 2018(2) dt.18-12-2018 2/3 accused persons tortured the daughter of the informant in several manner and lastly sent her daughter back to her parents' house. Thereafter, the informant transferred Rs.11,45,000/- in the account of the accused persons. Still the demand for dowry persisted. In the meantime, the daughter of the informant was killed by administering poison to her.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the First Information Report. Subsequently, the name of the petitioner sprang up during the investigation that he collected the clothes of the deceased while she was hospitalized. It is further submitted that wife of the petitioner, Chanchal Verma has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 37588 of 2018.

Learned APP submits that the name of the petitioner sprang up during the investigation.

Considering the fact that the petitioner is not named in the First Information Report and his name sprang up during the investigation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand)
