The petitioner seeks bail in Special Case No. 05 of 2018 arising out of Jogbani P.S. Case No. 59 of 2018, instituted for the offence under Section(s) 22, 23 and 24 of N.D.P.S. Act.

It is alleged in the written report that on seeing the Police party, one person fled away leaving the Motorcycle at Indo Nepal Border. On search, 5 Kg. of Ganja has been recovered from the aforesaid Motorcycle.

Counsel for the petitioner submits that name of petitioner has come during investigation on the basis that petitioner is owner of the aforesaid Motorcycle. Petitioner was not apprehended on spot. He has no concern with the aforesaid

Petitioner is in custody since 10.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria, in connection with Special Case No. 05 of 2018 arising out of Jogbani P.S. Case No. 59 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
