Petitioner is not named in the first information report but in course of investigation, stolen mobile sets were recovered from the house of the petitioner by police of Barahara police station and having got the aforesaid information, Investigating officer of this case reached there and verified the aforesaid fact and made him accused in the present case.
The submission on behalf of the petitioner is that the aforesaid recovery was made from joint house of the petitioner and, as a matter of fact, police was chasing some criminals who threw the aforesaid stolen mobiles kept in the bag in the court-yard of the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the period of
Patna High Court Cr.Misc. No.39833 of 2015 (3) dt.09-11-2015 detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Ara Town P.S.
