JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being headmaster of a school is said to have taken Rs. 18,23,000/- as advance for construction of work but he got completed the work only to the tune of rupees six lacs. Submission on behalf of the petitioner is that the remaining amount had been given to different agencies for completion of the work but in the meantime, the present F.I.R. was lodged and petitioner was arrested. It is further contended by him that petitioner not only prayed before the Superintendent of Police but also before the court below for giving some time so that petitioner could get the work completed but the prayer of the petitioner was not heard.

Patna High Court Cr.Misc. No.42443 of 2015 (3) dt.09-11-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail provisionally for the period of nine months from the date of receipt/production of copy of this order to the concerned court, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class-cum-Munsif, Vaishali at Hajipur in connection with Raghopur P.S. Case No. 135 of 2013, subject to condition that he shall ensure the completion of remaining work within the above stated period and shall produce the completion report before the court below and if he does so, the learned court below shall pass order for confirmation of provisional bail of the petitioner.

With the aforesaid observation, this petition stands disposed of.
