JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The deceased died within ten months of her marriage in other than normal circumstances. Petitioner happens to be husband of the deceased and there is allegation of illegal demand and torturing against him.
Accordingly, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Sarairanjan P.S. Case No. 96 of 2014 pending in the court of Chief Judicial Magistrate, Samastipur stands rejected.
However, the concerned court must commit the case of the petitioner to the court of Sessions in accordance with law as
Patna High Court Cr.Misc. No.42502 of 2015 (4) dt.09-11-2015 2/2 early as possible, if the same has not been committed as yet and after commitment, the Sessions court should expedite the trial of the petitioner.
