2. Petitioner seeks regular bail in connection with Sonepur P.S. Case No. 984 of 2022 dated 21.12.2022 registered for the offences punishable under sections 364 and 386 read with section 34 of the Indian Penal Code.
3. The main submissions advanced by petitioner's counsel are that the petitioner has clean past history and the FIR has been registered against eleven persons, including the petitioner, with regard to abduction of the informant's brother at the direction of co-accused, namely, Mantu Gop @ Mantu Rai and in the FIR the petitioner's specific role in the commission of the alleged occurrence has not been revealed and several coaccused persons carrying similar nature of allegation, have been enlarged on bail by the trial court itself while the petitioner's
Patna High Court CR. MISC. No.56234 of 2025(2) dt.12-08-2025 2/2 prayer has been rejected without differentiating his case from those of the co-accused persons. It is further submitted that on the same day of the alleged occurrence, the victim was recovered from the house of co-accused Mantu Gop and thereafter, good relation has been restored in between both the parties and the victim has filed a compromise petition before the trial court. It is lastly submitted that the petitioner has been languishing in jail since 23.06.2025.
4. Though learned APP for the State has opposed the prayer of the petitioner but fairly accepts that the case of this petitioner stands on similar footing with the co-accused persons, who have been granted bail by the trial court.
5. Considering the aforesaid submissions, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Sonepur P.S.
