JUSTICE RAKESH KUMAR ORAL ORDER 10-12-2015 Heard Sri Raj Kumar, learned counsel for the petitioners and learned Addl. Public Prosecutor. Four petitioners, who are in custody since 25.09.2015 in connection with Bhawanipur P.S. Case no.209 of 2015, registered for the offence under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Excise Act, have prayed for grant of bail.
Learned counsel for the petitioners submits that the petitioners are in custody since 25.09.2015. It was alleged that about 50 litres country-made liquor was recovered from the joint possession of petitioner nos. 1 and 2 and 35 litres of country-made
Patna High Court Cr.Misc. No.52800 of 2015 (2) dt.10-12-2015 2/2 liquor was recovered from the possession of petitioner nos.3and 4. Keeping in view nature of accusation and period of custody, let the petitioners, namely, (i) Pappu Uraon (ii) Ashok Uraon (iii)Sanjay Hembram and (iv) Sunil Basuki be released on bail on furnishing bail bond of Rs.10,000/-( Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Bhawanipur P.S. Case no.209 of 2015..
