ANJANA MISHRA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Bithan P.S. Case No. 26 of 2016 registered for the offences punishable under Sections 341, 323, 379, 308 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that though there is allegation against these petitioners, the injuries purported to have been inflicted, have been found to be simple in nature.
In view of aforementioned facts and circumstances of the case and that petitioner no.3 is a man of clean antecedent
Patna High Court Cr.Misc. No.38096 of 2016 (2) dt.18-10-2016 2/2 whereas a simple case is said to have been filed against the petitioners no.1, 2 and 4 which have been subsequently compromised, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Bithan P.S. Case No. 26 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
