This is an application for regular bail in connection with Tikapatti P.S. Case no. 58 of 2017 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

Informant, who is the father of the victim girl, has stated that his daughter was taken away by petitioner with intention to marry her. The girl had been recovered and she was subjected to medical examination and as per medical report, her age was assessed to be 17/18 years and no sign of any physical assault was found upon the victim. No sign of sexual intercourse or spermatozoa was found. In her statement recorded before the Magistrate under Section 164 of the Code of Criminal Procedure she has stated that she has been forcibly

Patna High Court Cr.Misc. No.58775 of 2017(3) dt.11-01-2018 2/2 married with the petitioner in the temple and thereafter she was residing with him for the last two months. Thereafter, police took her before the Magistrate for recording her statement under Section 164 of the Code of Criminal Procedure. She has also stated that she is willing to live with her parents. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea in connection with Tikapatti P.S. Case No. 58 of 2017.
