JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 10.11.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners are named in the first information report and it is alleged that petitioner no.1 went at the house of the victim and took her from her house and thereafter, petitioners and two other named accused took the victim in a tempo.

Although informant claimed herself to be eye-witness of the alleged occurrence but except informant none of the prosecution witnesses claimed to have seen the alleged occurrence. Petitioner no.1 happens to be owner of the tempo which is said to have been used in committing the said crime. Petitioners do not have any criminal antecedent and having more or less similar allegation co-accused Mahboob Miya and Bikram Mandal have already been granted privilege of bail by a coordinate bench of this

Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Sultanganj P.S. Case no. 306/2014. shahid (Hemant Kumar Srivastava,J) U T
