Petitioner is apprehending his arrest in connection with Hajipur Sadar PS Case No. 345/2018 for the alleged offence under Sections 147, 148, 149 and 414 of the Indian Penal Code and Section 4/ 5 of the Explosive Substances Act. Learned counsel representing the petitioner submits that name of the petitioner has surfaced on the disclosure made by one Dilip Sahni who was arrested by the police from whose possession explosive substance was recovered. Learned counsel further submits that petitioner is innocent and nothing was recovered from the house of the petitioner to connect him with the commission of the crime.

Considering the aforesaid, this application is allowed. Accordingly, in the event of arrest or surrender before

No.74335 of 2018(2) dt.21-12-2018 2/2 the court below within a period of one month from today, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate,Vaishali at Hajipur in connection with Hajipur Sadar PS Case No. 345/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as also on the condition that one of the bailors should be either Mukhiya or Sarpanch or any other elected representative of the local Panchayat.
