Prayer is for bail in Kurtha (Manikpur O.P.) P.S. Case No. 92 of 2017 registered under sections 323, 324, 307, 504, 506/34 of the Indian Penal Code.
Petitioner, being the nephew of the informant, is alleged to have assaulted the informant with spade on head. The impugned order reflects that the informant received grievous injury on head. Learned counsel submits that owing to land dispute, the occurrence had taken place. The informant himself lodged the written report which provided the basis of the F.I.R. He has no criminal antecedent. He is languishing in jail since 17.07.2017. There is no repetition of blow.
Counsel for the State opposed the prayer.
Patna High Court Cr.Misc. No.52450 of 2017(2) dt.20-11-2017 2/2 Considering the allegation and the material reflecting from the record, the prayer for bail is rejected. The petitioner shall, however, be at liberty to renew prayer for bail in the Court below itself after five months which shall be considered on its own merit uninfluenced by the present order.
