JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-11-2017 The petitioner seeks regular bail in connection with Shikarpur P.S. Case No. 318 of 2017, registered for offences punishable under Sections 20 and 22 of the NDPS Act. Allegation against the petitioner is of recovery of 3 kilo 200 grams of ganja.
It has been submitted on behalf of the petitioner that two accused persons have been arrested including petitioner in this case and nothing has been recovered from conscious possession of the petitioner. Further petitioner has remained in custody for three and half months and has no criminal antecedent. Heard learned A.P.P.
Having heard both sides, considering the fact and
Patna High Court Cr.Misc. No.49794 of 2017 (3) dt.10-11-2017 2/2 circumstances of the case and also in view of the recovery, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to release the petitioner to his own satisfaction once charge is framed in this case or petitioner completes six months in judicial custody, whichever is earlier with condition that he will cooperate in disposal of trial and shall present himself on each and every date.
