The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

It is a case of cruelty due to non-fulfilment of dowry demand.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that petitioners are named in the FIR but after completing the investigation, the petitioners are not sent up for trial although chargesheet has been submitted against co-

Patna High Court CR. MISC. No.66881 of 2021(2) dt.18-07-2022 2/2 accused who is the husband of the informant's namely, Pradeep Kumar. He further submits that they have no concern with the mess and business of the informant as well as the husband of the co-accused, namely, Pradeep Kumar. The cognizance has also been taken under Section 498A of the IPC by the learned trial Court.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 9th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Kalyanpur P.S. Case No. 304 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
