Mr. Upendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks regular bail in connection with Ahiyapur P. S. Case No. 59 of 2017, registered for the offence punishable under Section 392 of IPC.
Earlier prayer for bail of the petitioner was rejected vide order dated 05.10.2018 passed in Criminal Misc. No. 53148 of 2018. It appears that there is recovery of one vehicle from the garage of one Mohd. Ali. Apart from that he is accused in five other cases also.
Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner. Petitioner is in custody for more than two years. Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances, as stated above and considering the custody of
Patna High Court CR. MISC. No.64136 of 2019(3) dt.18-12-2019 2/2 the petitioner, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 13th Additional Sessions Judge, Muzaffarpur, in connection with Ahiyapur P. S. Case No. 59 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to appear before the court as and when required and further he has to appear before the local police station of his area for a period of nine months, so that, the police may watch his conduct, otherwise, his bail bonds shall be cancelled.
Let a copy of this order be communicated to the S.S.P. Muzaffarpur, for needful.
