Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Koilwar P.S. Case No. 372 of 2021, for the offences under Sections 147, 341, 323, 353, 427, 504/149 of the Indian Penal Code.

Patna High Court CR. MISC. No.68108 of 2021(2) dt.02-06-2022 2/3 As per allegation, accused persons attacked the police party and dismantled their vehicles while the raid was being conducted against illegal excavation of sand. They were 100 in numbers.

Learned counsel for the petitioners have submitted that although 32 persons have been implicated and 100 unknown persons were also alleged in this case but there is no allegation of assault against the petitioners, neither any person sustained any kind of injury. The petitioners are the persons of clean antecedents. He has also submitted that other co-accused persons on similar ground, have been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 61148/2021.

Considering the above mentioned facts and circumstances, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara (Bhojpur), in connection with Koilwar P.S. Case No. 372 / 2021, subject to condition as laid down under section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the
