Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bikramganj P.S. Case No. 402 of 2020, for the offences under Sections 429, 153A, 295A, 34 of the Indian Penal Code, Section 11 of the Prevention of Cruelty to Animals Act, 1960 and Section 345 R/W 429 of Bihar Municipality Act, 2007. As per allegation, police apprehended a truck loaded
Patna High Court CR. MISC. No.66670 of 2021(2) dt.01-06-2022 2/3 with meat and beef. On raid, the miscreants fled away and Chowkidar apprised the police party about their names as Ishaq Qureshi, Yusuf Qureshi, Ismile Qureshi, Ishrile Qureshi and Iqbal Qureshi.
Learned counsel for the petitioner has submitted that petitioner was not arrested on the spot. He has falsely been implicated and he is a person of clean antecedent, even he was not amongst five persons whose names were disclosed by the Chowkidar. He has further submitted that on similar allegation, the court below itself granted anticipatory bail to co-accused Mubarak in A.B.P. No. 272 of 2021.
Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned A.C.J.M., 1st, Bikramganj, DistrictRohtas, in connection with Bikramganj P.S. Case No. 402 of 2020, subject to condition as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove,
