2. Petitioner seeks regular bail in connection with Naugachia P.S. Case No.106 of 2024 registered under Sections 8, 20(B), 11(B), 25 and 29 of N.D.P.S. Act.

3. As per prosecution case, on secret information that petitioner and other co-accused person are engaged in sell of illegal ganja from their house, a raid was conducted by police and in course of search, 2 kg ganja was recovered from below the staircase of the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to enmity. In fact, no occurrence as alleged has ever taken place. While raid was conducted, no one was present in

Patna High Court CR. MISC. No.54951 of 2025(2) dt.12-08-2025 2/2 the house of petitioner. It is further submitted that petitioner was not apprehended on the spot. Nothing incriminating material has been recovered from the person or possession of the petitioner as the petitioner and his family members had gone to attend a marriage ceremony in another village on 03.04.2024. In absence of petitioner and his family members, the local anti-social elements kept the said ganja in his house and informed the police. Petitioner has no criminal antecedent and he is in jail since 27.06.2025. Petitioner undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Bhagalpur in connection with Naugachia P.S. Case No.106 of 2024.
