The petitioners apprehend their arrest in Piprakothi P.S. Case No. 62 of 2021 registered for the offence punishable under Sections 420, 414, 272, 273, 34 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act. 35.820 litres of illicit foreign liquor has been recovered from the house of this petitioner no. 1, whereas, 53.250 liters of foreign liquor was recovered from the house of petitioner no. 2.

Considering the fact that recovery of illicit foreign liquor has been effected from the houses of these petitioners and in view of restriction imposed under Section 76 (2) of Bihar

Patna High Court CR. MISC. No.66902 of 2021(2) dt.24-05-2022 2/2 Prohibition and Excise Act, I am not inclined to extend the privilege of anticipatory bail to the petitioners and accordingly, same is rejected.
