11-09-2017 In the last week, when the matter was taken up, on oral prayer of learned counsel for the petitioner, the case was adjourned to enable him to get instruction and file affidavit regarding steps taken in compliance with order dated 04-12-2014 passed by a Bench of this Court, whereby petitioner no. 3 was directed to deposit Rs. 750/- (seven hundred and fifty) per month in the court below.

Learned counsel for petitioners, in presence of learned Addl. Public Prosecutor as well as Sri Pravin Kumar Sinha, learned counsel for the opposite party no. 2, submits that despite his best effort, he has not been able to get further instruction.

Patna High Court Cr.Misc. No.44826 of 2014(3) dt.11-09-2017 2/2 Accordingly, there is no need to further keep the matter pending. Moreover, the petitioners have prayed for quashing of order of cognizance in Complaint Case No. 251 of 2013, which has been passed after completion of enquiry. Learned counsel for petitioners makes a prayer for disposal of the present petition with indication that if so advised, petitioners may take all the pleas, which have been taken in the present petition, before the court below at appropriate stage. The prayer is allowed.

The petition stands disposed of with liberty, as indicated above.
