2. 2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 307 of the Indian Penal Code and Section 27 of Arms Act.

3. As per prosecution case, both the petitioners are alleged to have opened fire upon the brother of the informant namely, Santosh Kumar who sustained injury.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case. The petitioners have no intention to harm or kill anyone. The alleged incident

According to the injury report, it appears one lacerated wound on left side of back and multiple small burnt on left arm and elbow but the nature of injury is opined as simple. The petitioners have got no criminal antecedent as stated in para-3 of the bail petition. It is further submitted that the petitioner nos. 1 & 2 are languishing in judicial custody since 21.5.2023 and 13.5.2023 respectively.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case custody period of the petitioners, this court is inclined to enlarge them on bail. The above named petitioners are directed to be released on bail in connection with Mokama P.S. Case No. 158 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 3rd Barh, Patna.
