2. The present writ petition has been filed for the following relief/s:- "A. To direct the respondent authority to conceal the selection and appointed to the Respondent no. 5 to the post of Aganwadi Sevika in Umga Panchayat ward no. 14, Madanpur, Aurangabad who has been Illegally selected to the post of Aganwadi Sevika and

Patna High Court CWJC No.13233 of 2025(2) dt.22-06-2026 2/3 ignoring the rightful claim of the petitioner. B. To directs the respondent Authority to selection and appointed the petitioner in place of Respondent no. 5 to the post of Aganwadi Sevika in Umga Panchayat, Madanpur, Aurangabad.

C. Any other appropriate writ order or direction which this Hon'ble Court may deem fit and proper in this circumstances."

Learned counsel for the State raised preliminary objection and submits that by virtue of this writ petition, the petitioner has challenged the appointment of private respondent no.5 on the post of Anganwadi Sevika. Counsel submits that as per the relevant margdarshika for the appointment of Anganwadi Sevika and Sahayika, the petitioner ought to file a case before the concerned District Programme Officer.

4. In response thereof, learned counsel for the petitioner submits that the petitioner has filed a representation vide Annexure-P/2 and thereafter, moved before this Hon'ble Court.

5. In this view of the matter, the present writ petition stands disposed off with liberty to the petitioner to avail her remedy by filing a case before the concerned District Programme Officer afresh under the relevant margdarshika for
