JUSTICE BIRENDRA KUMAR ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending her arrest in a case registered for the offence punishable under Section 366(A) of the Indian Penal Code.

The petitioner is wife of co-accused Dharmendra Choudhary though allegation is against the petitioner also to have kidnapped to the victim girl. The victim in her statement under Section 164 Cr.P.C. leveled allegation against Dharmendra only and she specifically stated that when the petitioner was prohibiting Dharmendra not to do anything against the victim girl, Dharmendra assaulted to the petitioner also. Submission is that the matter appears to be of love affairs between Dharmendra and the victim girl.

Patna High Court Cr.Misc. No.52669 of 2017 (2) dt.09-11-2017 P2/ Considering the facts aforesaid, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Bhabhua Police Station Case No. 227 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
