JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kusheshwar Asthan P.S. Case No. 333 of 2015, registered under Sections 406, 420, 336, 342, 343, 347, 467, 468 and 471/34 of the Indian Penal Code and Section 30(2) of Bihar Clinic Establishment Act, 2013.

The accusation is that on receiving secret information by the Police that one Tapeshwar Singh @ Lal Babu used to run a private hospital in the name of "Maa Durga Swasthya Seva Sadan" situated at Girgitiya Chowk, Sahorba. The Police officials raided the said hospital, in course of raid of the said hospital co-accused Tapeshwar Singh @ Lal Babu and Salikta Kumari were found engaged in operation of the parents in the O.T. On query, they failed to produce

Learned counsel for the petitioner submits that petitioner has not named in the F.I.R. Further submission is that, in fact, the petitioner was engaged in the said hospital as O.T. Attendant and as such he has no concerned about running of the hospital. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Biroul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 333 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
