This application for anticipatory bail arises out of Dumra P.S. Case No. 94 of 2018, disclosing offences under Sections 341, 323, 363, 365, 504 and 506/34 of the Indian Penal Code.

The allegation against the petitioner is that he forcibly dragged the petitioner into his car and abducted him. When he was being taken away towards Muzaffarpur, the informant managed to jump from the vehicle.

Learned counsel for the petitioner has submitted that the criminal case has been maliciously instituted because both the petitioner and the informant were contesting local body election and though both lost, the informant is still nurturing

Patna High Court Cr.Misc. No.73126 of 2018(2) dt.19-12-2018 2/2 grudge against the petitioner.

Considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Sitamarhi in Dumra P.S. Case No. 94 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
