Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 353, 307, 302, 201, 379 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the C.L.A. Act.
Submission is that the allegation is not specific against the petitioner and he is in custody since 2015. However, petitioner was remanded only in the year 2019 in this case in spite of the prayer of remand of the petitioner made earlier. Further submission is that co-accused Tengar Sada and Bohran Sada @ Borhan Sada have already been allowed bail by different Coordinate Benches of this Court vide order dated 02.09.2015 passed in Cr. Misc. No. 37149 of 2015 and order dated 17.09.2015 passed in Cr. Misc. No. 22627 of 2015.

No.53640 of 2019(2) dt.30-08-2019 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T. No. 246 of 2015 arising out of Salkhua Police Station Case No. 82 of 2007, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
