The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 419 and 420 of the IPC.

The prosecution case, as per the written report of Rakesh Kumar, dated 10.03.2018 submitted to the Station House Officer, Katoria Police Station, is to the effect that the petitioner being the Store In-Charge of Reliance Jio Point at Katoriya, all of a sudden, transmitted his resignation letter through an E-mail, without handing over the charge of the store to anyone. Subsequently, the informant, Rakesh Kumar, being the employee of Jio Mobile company, traced out that articles worth Rs. 2,50,000/- and cash amounting to Rs. 1,50,000/- are missing from the store.

No.70761 of 2018(2) dt.19-12-2018 2/2 It is submitted by learned counsel for the petitioner that there is nothing in the FIR that any such articles or money was entrusted to the petitioner. The petitioner has been roped in the present case simply because he has resigned. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that there is specific accusation against the petitioner.

Considering the nature of accusation and delayed lodging of the FIR, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Katoriya P.S. Case No. 38 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
