Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 325, 506 and other ancillary sections of the Indian Penal Code. Prosecution case is that co-accused Pintu Kumar and petitioner no.1 pointed pistol on the chest of the informant and took out Rs.2040/- from his pocket. On protest, they assaulted the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Present case is counter blast of Giriyak Katrisarai Police Station Case No. 245 of 2021 lodged by wife of petitioner no.1 against the informant and others. Allegation of assault is general and omnibus in nature. Petitioner no. 2 has got no criminal antecedent.

Considering the nature of allegation, prayer for bail of the petitioner no.2 is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner no.2 mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court of Chief Judicial Magistrate, Nalanda at Biharsharif in Giriyak Katrisarai Police Station Case No. 244 of 2021 from subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
