The petitioner apprehends his arrest in connection with Narpatganj P.S. Case No. 342 of 2013 registered for the offences punishable under Sections 448, 341, 323, 427, 385/34 of the Indian Penal Code and Section 3 (1) (x) (iii) of the SC/ST Act. Learned counsel for the petitioner submits that the allegation as against the petitioner under Section 3 (1) (x) (iii) of the SC/ST Act has been added only to implicate the petitioner in the present case so that he may have to bear the rigorous of the said Act.

No.43666 of 2014 (2) dt.27-03-2015 2/2 It is further submitted that from the First Information Report itself, it appears that earlier for the same offence of abusing him by his caste name, a case bearing Narpatganj P.S. Case No. 330 of 2013 had been registered under the relevant sections of the SC/ST Act. Considering the aforesaid submissions and the nature of allegation, let the petitioner above named , in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 342 of 2013 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. (Anjana Mishra, J) Jagdish/- U T
