The petitioner seeks bail in connection with Dharhara P.S. Case No. 87 of 2017 dated 06.06.2017 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code. The petitioner is the mother-in-law of the deceased and she is in custody since 06.06.2017. The informant of the present case is the brother-in-law of the deceased, who had actually got the marriage of the deceased solemnized with the son of the petitioner. In the F.I.R., he has alleged that on an earlier occasion when the deceased had come to her parents' house in connection with marriage of her brother, she had disclosed that her husband and the in-laws had demanded dowry and had also tortured her. Patna High Court Cr.Misc. No.50725 of 2017 (3) dt.01-12-2017 2/2 persons, the deceased went back to her matrimonial home and was residing there from 12.05.2017. A day before the lodging of the F.I.R., the elder brother of the husband of the deceased informed the informant that the deceased has committed suicide. The informant has alleged that all the family members of the deceased have killed her.
Learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner, who is a lady (mother-in-law).
Taking into account the fact that the petitioner is mother-in-law of the deceased and she is in custody since 06.06.2017, this Court is inclined to grant bail to her. The petitioner above named is directed to be released on bail on her furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Munger in connection with Dharhara P.S.
