The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

356.40 liters of foreign liquor has been recovered from the house of co-accused Vijay Kumar, who disclosed that he has given a room to this petitioner on rent and aforesaid liquor has been brought by this petitioner.

It is submitted on behalf of petitioner that no incriminating has been recovered from his conscious possession. Recovery has been effected from the house of co-accused and he has got no concern either with the said liquor. Petitioner claims clean antecedent.

II- cum-Special Judge (Excise Act), Darbhanga in connection with Sadar P.S. Case No. 282 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
