The petitioner seeks bail in Madhepura P.S. Case No. 435 of 2014 registered under Sections 467, 468, 469, 471, 420, 409 and 120B of the Indian Penal Code.

Accused Balram Yadav, Assistant Teacher, Madhya Vidyalaya Khopaiti is said to have illegally incorporated his name in the letter of nationalization and wrongfully withdrew salary showing him an acting Assistant Teacher of the said school in collusion of the petitioner.

It is submitted by learned counsel for the petitioner that Balram Yadav was in service in the aforesaid school since before. Dharmdeo Prasad Manindra was the Headmaster of the

Patna High Court Cr.Misc. No.53341 of 2017 (3) dt.12-12-2017 2/2 aforesaid school while the petitioner was the Assistant Teacher during his tenure and after superannuation of Dharmdeo Prasad Manindra, he became incharge of the said school. He has simply attested the photostat copy of the letters of the accused Balram Yadav. Payment of salary has been made to the said accused on the direction of Deputy superintendent of Education. In Para-8 of the Letter No. 1070 dated 30.09.2013 attached with the F.I.R., District Education Officer has specifically stated that the petitioner has attested the photostat copy of the letters relating to Balram Yadav. The petitioner has been languishing in custody since 22.07.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Madhepura in connection with Madhepura P.S.
