JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 This is an application for grant of anticipatory bail in connection with Salkhua P.S. Case No. 170 of 2016, disclosing offences under Sections 147, 149, 379, 384, 504, 506 of the Indian Penal Code.

Prosecution case is that the horse of the informant was stolen and thereafter, he inquired from one Hira Yadav, who asked Rs.50, 000/- to recover the horse to produce the same and again one Horse was stolen and thereafter, Hira Yadav demanded Rs.35,000/- in finding out the same and it appears that Hira Yadav along with his members are stolen the cattle. It is also alleged that the informant and other went to the complainant about the same to the petitioner, who happens to be the father of Hira Yadav to the accused and also assaulted them. Submission of the learned counsel for the petitioner is that even according to the F.I.R. there is allegation against one

Patna High Court CR. MISC. No.52395 of 2019(2) dt.22-08-2019 2/2 Shankar and the petitioner has falsely been implicated in this case, as he happens to be the father of Hira Yadav. He has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.- IV, Saharsa, in connection with Salkhua P.S. Case No. 170 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
