1. Heard the learned counsel for the parties.

2. Earlier, the prayer for bail of the petitioner was rejected, vide order dated 07.01.2022 passed in Cr. Misc. No. 37613 of 2021.

3. The trial court report reveals that in this case, all ten prosecution witnesses have already been examined by the prosecution and thereafter, the prosecution evidence was closed and the statement of accused persons were recorded. An application dated 25.07.2023 was filed on behalf of prosecution under Section 311 Cr.P.C. and the same is allowed by the Court below vide order dated 18.09.2023.

4. Considering the nature of accusation and progress of the trial, the prayer for bail of the petitioner is

Patna High Court CR. MISC. No.57488 of 2023(3) dt.03-11-2023 2/2 rejected. However, petitioner is in custody since 13.07.2020, the trial court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of a copy of this order.
