The petitioner is in custody in connection with Makhdumpur (Tehta) P.S.Case No.122 of 2017 registered for an offence under Sections 307 and ancillary Sections of the IPC. It is alleged that when the police party visited at the place of occurrence and arrested some of the accused in connection with criminal cases pending against them. Altogether five to seven persons came and started indiscriminate firing. Learned counsel for the petitioner submits that this petitioner has been named merely on suspicion. The informant or any of the police personnel neither sustained any injury nor there is any incriminating material against the petitioner. The petitioner

Patna High Court Cr.Misc. No.60456 of 2017 (2) dt.19-12-2017 2/2 has voluntarily surrendered before the court below on 16.08.2017 and since then he is in custody.

The learned APP opposed the submission.

Considering the aforesaid facts and circumstances of the petitioner, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Jehanabad in connection with Makhdumpur (Tehta) P.S.Case No.122 of 2017.
