The petitioner is apprehending arrest in a case registered for the offences punishable under sections 3,4,5,6 and 7 of the Immoral Traffic (Prevention) Act.

The prosecution case is that the petitioner let out his house for running brothel house.

It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the house in question belongs to the petitioner nor there is anything on record to suggest that the petitioner was aware about the illegal activities of the persons who took the house on rent. Statement has

Patna High Court Cr.Misc. No.54518 of 2015 (2) dt.02-12-2015 2/2 been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that the accusation is against co accused lady who was running flesh trade, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Kotwali P.S. Case No. 199 of 2011 pending in the court of learned CJM, Gaya. This application is disposed of with the aforesaid observation/direction.
