The petitioner is apprehending his arrest in a case registered under Sections 315, 326, 417, 420 and 471/34 of the Indian Penal Code.

The informant alleged in his written report that the petitioner is not MBBS doctor but he is treating different persons and doing surgery, even during course of delivery many ladies died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not a medical doctor. He is simply looking after the

Patna High Court Cr.Misc. No.42912 of 2016 (3) dt.13-12-2016 2/2 management of the Nursing Home. Dr. Nitesh Nandan is the treating doctor, who is practicing in the said Nursing Home. The other co-accused has been granted anticipatory bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Chandradip P.S. case No.78 of 2012 (G.R.
